Terms of Service

Please read these Terms of Service carefully before booking or using any of our driving lesson services. By making a booking, contacting us to arrange lessons, or using our website, you agree to be bound by these terms. If you do not agree, please do not proceed with a booking.
2. Eligibility
To book driving lessons with Smart Driving School, you must:
- Be at least 17 years of age (the minimum legal age to drive a car on public roads in the UK)
- Hold a valid UK provisional driving licence or be eligible to obtain one
- Be legally permitted to drive in the United Kingdom
- Be medically fit to drive in accordance with DVLA requirements
By booking a lesson you confirm that you meet all of the above requirements. We reserve the right to refuse or cancel a booking if eligibility requirements are not met.
3. Bookings and Confirmation
All lesson bookings must be made through one of our official booking channels — our website contact form, phone, or WhatsApp. A booking is confirmed only once you receive a confirmation from us directly.
We reserve the right to decline any booking at our discretion without being required to provide a reason.
You are responsible for providing accurate contact and pickup details at the time of booking. We cannot be held responsible for missed or delayed lessons caused by incorrect information provided by you.
4. The £10 Tester Lesson — Terms and Refund Guarantee
Our £10 tester lesson is a full 1-hour, one-to-one driving lesson with a DVSA-approved instructor. It is available for automatic cars only. The purpose of this lesson is to allow you to experience our instructor's teaching style before committing to further lessons.
The following terms apply specifically to the £10 tester lesson:
- The £10 tester lesson is available to new customers only — one per person
- The lesson is for automatic cars only and is not available for manual transmission
- Payment of £10 is required to confirm the booking
- The lesson is a full 1 hour in duration, conducted one-to-one with your assigned instructor
- If, after completing the lesson, you feel the instructor is not the right fit for your learning style, personality or schedule, you are entitled to a full £10 refund
- Refund requests must be made within 24 hours of the lesson ending
- Refunds will be processed promptly via the original payment method or bank transfer
- The refund guarantee applies only where the lesson has been completed in full — partial lessons do not qualify unless the lesson was cut short by the instructor
- The £10 tester lesson cannot be used in conjunction with any other offer or discount
We reserve the right to withdraw the £10 tester lesson offer at any time, but any confirmed bookings made before withdrawal will be honoured under these terms.
5. Lesson Pricing and Payment
Our current lesson prices are as follows:
- Single Lesson — £40 per hour (minimum 2 hours)
- Refresher Lesson — £45 per hour (minimum 2 hours)
- Fast Track – 10 Hours — £380
- Intensive Assessment — £80 (2 hours)
- Pass Plus — £240 (6 hours)
- Motorway Driving — £150 (3 hours)
- Practical Driving Test Package — £150 (includes 1-hour pre-test lesson, car hire during test, and required insurance)
All prices are inclusive of VAT where applicable. We reserve the right to update our pricing at any time. Any change in price will not affect lessons or packages already paid for.
Payment is due at the time of booking or as otherwise agreed. We accept payment via bank transfer, WhatsApp Pay, or other methods confirmed at the time of booking.
6. Cancellation and Rescheduling
By the student:
- Cancellations or rescheduling requests made with more than 48 hours notice will incur no charge and the lesson will be rescheduled or refunded
- Cancellations made with less than 48 hours noticemay result in the full lesson fee being charged
- Cancellations made with less than 24 hours notice or no-shows will be charged the full lesson fee
By Smart Driving School or the instructor:
- In the unlikely event we need to cancel a lesson, we will give you as much notice as possible
- You will be offered a replacement lesson at a mutually convenient time or a full refund for that session
- We are not liable for cancellations caused by circumstances outside our control including severe weather, vehicle breakdown, illness or road incidents
7. Lesson Conduct and Instructor Authority
During your lesson, the DVSA-approved instructor is the qualified professional responsible for road safety. You agree to:
- Follow the reasonable instructions of your instructor at all times during lessons
- Arrive on time for your scheduled lesson at the agreed pickup location
- Not be under the influence of alcohol, drugs or any substance that may impair your ability to drive safely
- Inform your instructor of any medical condition that may affect your driving before the lesson begins
- Treat your instructor with respect — abusive, threatening or inappropriate behaviour will result in the lesson being terminated immediately with no refund
The instructor has the right to terminate any lesson immediately if they believe continuing poses a risk to road safety, and no refund will be issued in such circumstances.
8. Vehicles and Insurance
All driving lessons take place in dual-control vehicles provided by our instructors. These vehicles are roadworthy, maintained to a high standard, and covered by appropriate motor insurance for learner drivers.
You are not permitted to use the lesson vehicle for any purpose other than the scheduled lesson. Any damage caused to the vehicle through reckless or deliberate actions beyond normal learner driver mistakes may result in costs being sought from you.
For the Practical Driving Test package, insurance is included for the duration of the test. This insurance is valid only for the test itself and does not extend beyond the test session.
9. Block Bookings and Packages
Where you purchase a lesson package (such as the Fast Track 10-hour course), the following applies:
- Packages must be used within 12 months of the purchase date unless otherwise agreed
- Unused hours in a package are non-refundable after the 12-month period has expired
- If you wish to cancel a package before it has commenced, a full refund will be provided
- If a package has partially commenced, a refund will be issued for unused hours at the standard hourly rate minus any discount already applied
10. Pass Rate and Outcomes
While we aim to prepare every student to the highest possible standard, Smart Driving School cannot guarantee that you will pass your theory or practical driving test. Passing your test depends on a wide range of factors including your individual progress, test day performance and DVSA examiner assessment.
Our instructors will always provide honest feedback about your readiness to take the test and will recommend the test only when they believe you are prepared to the required standard.
11. Complaints
We are committed to providing a high quality service. If you are unhappy with any aspect of your experience, please contact us as soon as possible so we can resolve the issue:
We will acknowledge your complaint within 3 working days and aim to resolve it within 14 working days. If we are unable to resolve your complaint to your satisfaction, you may seek further guidance from Citizens Advice or Trading Standards.
12. Limitation of Liability
To the fullest extent permitted by law, Smart Driving School's liability to you in connection with your lessons or use of our website is limited to the amount paid for the specific lesson or service in question.
We are not liable for any indirect, consequential or special losses including loss of earnings, loss of opportunity or any costs arising from failing a driving test. Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for any other liability that cannot be excluded under English law.
13. Website Use
You may use our website for lawful purposes only. You must not misuse our website by knowingly introducing viruses or other harmful material, attempting to gain unauthorised access to our systems, or using the site in any way that is fraudulent or harmful to others.
We make reasonable efforts to keep the website accurate and up to date but do not guarantee that all information is error-free at all times. Prices and availability shown on the website are subject to change without notice.
14. Changes to These Terms
We may update these Terms of Service from time to time. The date at the top of this page will reflect the most recent update. Changes will not affect any existing confirmed bookings made prior to the change. Continued use of our services or website after changes are posted constitutes acceptance of the updated terms.
15. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of England and Wales.
